BC FAMILY LAW

Posts about different issues in BC Family Law

In British Columbia (BC),  Family Law includes both Federal laws such as the Divorce Act and Provincial laws such as the Family Law Act.  Both legislation and case law covers a wide range of legal issues that are pivotal in settling disputes and ensuring the well-being of families.

An experienced Family Law Firm like SEA TO SKY LAW can help you with many different topics such as divorce, child custody, spousal support, and property division. Each of these issues requires not only a solid understanding of the law but also the sensitivity to address the emotional complexities involved.

Family Law proceedings are often the most prevalent cases in Family Law including divorce applications and parenting problems. These cases can be further complicated by issues of child custody and visitation rights. In BC, child custody is known as Parenting Responsibilities while visitation rights is either Parenting Time if a Guardian or Contact time is not a Guardian.

A court cannot solve all future problems nor change the personalities of the parents involved.  Court orders can only solve the present problem.  Since being a parent is for life, experienced Family Law firms like SEA TO SKY LAW first try to negotiate and mediate these disputes to reach amicable co-parenting agreements, since the law prioritizes the best interests of children over any rights of  both parents.

In addition to divorce and custody, spousal support (or alimony) is another critical issue that SEA TO SKY LAW pursues for thir clients.  Child Support is dictated by the Child Support Guidelines but determining the appropriate amount and duration of spousal support involves assessing various factors such as the length of the marriage, financial disparities between the spouses, and each party's net worth.

Property division is often a significant legal concern in BC Family Law especially with the increased real estate values in Metro Vancouver.  SEA TO SKY LAW works hard to ensure a fair distribution of assets acquired during the marriage, which can include real estate, financial accounts, and personal property. Understanding the nuances of the law is essential for protecting clients’ interests and achieving equitable outcomes.

Lastly, family law issues can also extend to adoption, guardianship, and domestic violence cases. These situations demand a compassionate yet assertive legal approach to safeguard families' rights and ensure their safety. A well-equipped Family Law Firm like SEA TO SKY LAW provides comprehensive support across these multifaceted legal matters, fostering resolution and clarity for their clients.

BUSINESS LAW ISSUES

Propietorships, Partnerships & Corporations

When spouses separate or divorce, one of the critical legal issues that arises is the division of assets, particularly when one or both parties own a business. Family law firms like SEA TO SKY LAW often deal with the complexities involved in valuing a business during these proceedings. Business valuation is not only essential for ensuring a fair distribution of assets but also poses significant challenges due to various factors that can impact a company's worth.

One of the first steps in addressing business valuation in the context of divorce is understanding the corporate complexities when a business is incorporated. If there are other shareholders in addition to the spouses then their interests must be considered.

Businesses must be properly registered and compliant with  all laws and regulations especially the Corporate Registry, which can affect how assets are evaluated and divided. Failure to meet these requirements might complicate the divorce proceedings and can lead to further legal issues including the loss of the corporation by it being struck by the registry for failure to file the required annual report.

Moreover, accurately valuing a business is difficult because it involves analyzing financial statements, assessing market conditions, and considering tangible and intangible assets. Family lawyers like SEA TO SKY LAW often work alongside financial experts to determine an accurate valuation, which can include goodwill, customer relationships, and proprietary technology, all of which may be challenging to quantify.

During the asset division process, it is crucial that both spouses fully disclose their financial situations, including any complexities related to their business ownership. A lack of transparency can lead to disputes and inequitable outcomes, making it essential to approach this process with clarity and legal guidance from a family law firm like SEA TO SKY LAW who is experienced in these complicated matters.

Ultimately, navigating the intersection of business law and family law requires a nuanced understanding of corporate registry requirements and business valuation challenges. Engaging a knowledgeable family law firm can provide invaluable support to ensure that each spouse’s rights are upheld and that the division of assets is handled fairly and equitably.

ALIMONY aka Spousal Support

ALIMONY is also known as spousal support. I posted an article about child support which is mandatory (the support not the reading).  However spousal support is not always payable and child support takes priority if there is not enough income to pay both.

Like child support, there are Spousal Support Advisory Guidelines to help determine the amount payable but as the title suggests the Spousal Guidelines are advisory not mandatory though the courts have said these Guidelines must be considered.

Before determining the amount payable, you first determine if the spouse claiming support is eligible. The first key word is Spouse. If the adult claiming support was never a spouse as defined in the legislation then that is the end of the claim. You can become a spouse in British Columbia, not just by being married legally, but by living in a marriage-like relationship for 24 consecutive months. And of course the law applies to all sexes.

What is a "marriage-like" relationship versus just good friends with benefits is of course not clear in these modern times, so caselaw has developed to guide this analysis.

After the spousal relationship is confirmed, now you consider eligibility which has several categories - not just alleged need - and each has their own analysis. For example, at separation both spouses might be economically independent with similar incomes but if there were children then there could be a spousal claim for compensation eg if one of the parents stayed home to be the caregiver and lost years of employment experience.  If there was no loss caused by the marriage and both spouses are economically independent then there might not be any alimony payable.

If alimony is payable, there are a few more decisions to be made including whether it is to be permanent or only for a few years or reviewable, and whether to pay a lump sum which can be included in the debt & asset division analysis, or monthly income which is a tax deduction for the payor and taxable income for the recipient.

Though not strictly mandatory, the Spousal Support Advistory Guidelines (SSAG) must be considered to help determine if any alimony is payable for any reason.
